Access to employment from a gender equality perspective Abstract This thesis examines access to employment from a gender equality perspective. However, the content of the thesis has been narrowed down and focuses on access to employment in terms of unequal pay for women and men. The topic of the thesis has been chosen in view of its topicality in the context of the proposed Proposal for a Directive to enhance transparency in remuneration, which will have a significant impact on the Czech Republic. The main objective of the thesis is to present the issue of wage and salary inequality, to evaluate the current state of the legislative regulation of equal pay for men and women and to provide possible de lege ferenda solutions. The thesis is divided into an introduction, two main chapters and a conclusion. The first chapter defines the basic theoretical concepts related to gender pay inequality and also introduces the reader to the Czech legal regulation of equality and non-discrimination as the basic building blocks of gender pay inequality. The right to fair remuneration in labor relations Abstract This diploma thesis deals with the right to fair remuneration in labor relations. The topic was chosen mainly thanks to its still high topicality, which is confirmed, among other things, by the submitted proposal for a new directive of the European Commission. Fair remuneration is part of many strategies and initiatives, based primarily on the activities of the European Union, where the Czech Republic is significantly affected by those activities. The aim of this work is to analyze and evaluate the Czech legislation in the context of international sources, especially in comparison with European law. The thesis is divided into an introduction, five parts and a conclusion. The first part is an introduction to the basic concepts related to fair remuneration and to the functions of remuneration. The second part is devoted to selected international conventions, which enshrined the right to fair remuneration and thus significantly contributed to the development of social rights in individual Member States. The issue of fair remuneration The diploma thesis focuses on the issue of fair remuneration in the Czech Republic, or rather lack thereof. The aim of this paper is to outline and evaluate the legislation of fair remuneration that is currently in effect. It must be said that the current fair remuneration legislation, at the first sight, seems to be sufficient and effective in practice. However, that is not true yet, as one of the remaining issues of fair remuneration is the inequality in the remuneration of women and men, where women are generally paid less than men for the same work. This thesis comprises of five chapters. The first chapter provides an overview and evaluation of the legislation of fair remuneration. The second chapter attempts to define the term "fair remuneration" while also outlining other key terms. In general, fair remuneration is such that is in absolute accordance with the current legislation. However, that does not guarantee that such remuneration would be perceived as fair by the employees themselves. Therefore, each employee should know how he or she is remunerated and what specific criteria affect the amount of his remuneration.
